The decision states that the Trump government failed to show
what harm can cause the nationals of these countries that
have even remained in the United States for more than 20 years.
The ruling is the result of a class action lawsuit filed in
March by nine immigrants from those countries and five
American children. In it they argued that President Donald Trump
made statements with racial prejudices that could lead to the
cancellation of the TPS, this being something that prohibits the
Constitution.
“There is circumstantial evidence that race was a motivating element”
to end the TPS, argues the judge in his ruling citing examples given by
the plaintiffs, such as when in January 2018 during a meeting with
bipartisan lawmakers Trump referred to certain countries -El Salvador
and Haiti specifically- as “shit holes”.
The plaintiffs also asked the judge to dismiss the White House’s decision
arguing that Congress prohibited the courts from reviewing the decisions
of the Secretary of the Department of Homeland Security (DHS) to grant
or cancel the TPS.
On June 26, federal judge Edward Chen ruled in a preliminary ruling that
the courts had the authority to review the lawsuit requesting reinstatement
of the TPS, and noted that there could be racist motivations behind the
decision to cancel the program.
The TPS grants temporary protection from deportation and grants a
renewable employment authorization with each extension of the program.
